This policy applies to
any disease not known to be spread by casual, incidental contact. Such diseases include but are not limited to
AIDS, ARC, and Hepatitis B.
The term" AIDS
Affected Personnel" is defined to include any paid employee or voluntary
worker of the school system who has been diagnosed as having Acquired Immune
Deficiency Syndrome (AIDS) or AIDS Related Complex(ARC) which is a lesser form
of AIDS. Whenever the Phrase "Aids
Affected Personnel" is used in this policy, it includes any
employee/volunteers diagnosed as having AIDS or ARC.
The board of education
intends to handle cases involving AIDS affected personnel in a manner that
protect the employment rights and safety of the individual staff member, other
staff and students with whom the individual may come in contact, and the right
of confidentiality of the individual.
Whenever possible, it is
the board's intent for AIDS affected personnel to continue in their regular
employment assignment as long as no direct health threat or hazard in the
workplace exists for those person(s) with who he or she comes in contact. The superintendent is responsible for
assuring that procedural safeguards are used when deterring the employee status
of AIDS affected personnel
AIDS affected personnel
may be temporally excluded from their work upon the advise
of a medical advisor until such time that the case has been thoroughly reviewed
and a decision made about appropriate permanent action. If so, this exclusion will not result in a
loss of compensation to the employee.
