EMPLOYMENT RIGHTS AND RESPONSIBILITIES

 

SUPPORT STAFF and VOLUNTEERS

 

Qualifications, recruitment and selection of support staff

 

 

Managing the qualifications, recruitment and selection of candidates for classified and volunteer positions shall be the responsibility of the superintendent or designee who shall confer with principals and other supervisory personnel in making a selection.

 

Volunteers for the purpose of this policy shall include any individual who regularly works with or amongst students, who is not considered an employee and who has the ability to have contact with students when not under the direct supervision of a district employee. Parents and other individuals helping in the classroom for a classroom party or during field trips on an intermittent basis and who are not left to supervise children on their own shall not be considered volunteers for the purpose of this policy and shall not be subject to the requirements of this policy.

 

Persons interested in a support staff or volunteer position shall have an opportunity to apply and qualify for positions in the school district without regard to age, race, creed, color, sex, national origin, religion or disability. Job applicants for support staff positions shall be considered on the basis of the following:

·         Training, experience, and skill;

·         Nature of the occupation;

·         Demonstrated competence; and

·         Possession of, or ability to obtain, state or other license or certificate, if required, for the position.

 

Announcement of the position shall be through means the superintendent believes will inform potential applicants about the position. A position shall not be considered to be open if the Superintendent or his/her designee determines to fill the assignment through a change of assignment and/or responsibilities of existing personnel. If through a change of assignments and/or responsibilities results in the opening of another position, that position will be announced.

 

Applications for employment may be obtained from, and completed applications shall be returned to, the central administration office. A standard application form shall be completed for all volunteer and support staff positions to ensure the enforcement of non-discrimination employment procedures and for the purpose of completing a background check. A signed release shall be obtained from the prospective candidates authorizing reference and background checks.


 

The administrator who directly supervises and oversees the position shall conduct, whenever possible, the preliminary screening of applicants. The interviewer shall work from a written list of interview questions, using the same set of questions for each applicant. Gaps in the applicant's employment record will be questioned and checked.

 

A minimum of three reference checks made in person, by telephone, e-mail or in writing and using a standard list of questions shall be used in the screening process. These checks shall be documented and filed with the employee's records.

 

Prior to hiring any person, the district shall conduct background checks with previous employers regarding the applicant's fitness for employment along with a criminal background check.

 

All applicants who have not lived continuously in Nebraska for the past five years and who are recommended for a position in the district shall submit a set of fingerprints and a notarized form with information about felony or misdemeanor convictions. Applicants may be conditionally employed prior to receiving the fingerprint results.

 

The fingerprint requirement shall be waived for all persons who have submitted a set of fingerprints to another Nebraska district within the last two years and who have given written consent for transfer of their fingerprint records to the requesting district. The fingerprints will be used to obtain a Nebraska and/or FBI criminal records check.

 

The superintendent may waive the requirement for individuals from other agencies or institutions that work in the school if that institution has certified to the district that it has conducted background checks that are equivalent to or more stringent then those required by the district.

 

The superintendent shall recommend employment of support staff to the board for approval.

 

The Board shall officially appoint all employees and volunteers upon the superintendent's recommendation; however, temporary appointments may be made pending board action.
