Contract
The Board
of Education of the Ashland-Greenwood Public Schools shall accept students into
the district by way of a contract with the student’s parent/guardian or the
student’s resident district.
It shall be
the responsibility of the Superintendent of Schools to develop rules and
regulations regarding students under contract.
The
Superintendent shall be responsible for accepting and/or rejecting requests to
contract students on the basis of standards written in accordance with state
statutes as well as District #1 policies, rules and regulations.
Standards
and limitations shall be those provided by legislation, the Board of Education,
as well as those recommended by the administration and adopted by the Board of
Educations. The standards shall include
but not be limited to physical capacity for the respective grade level, class,
class section, program, or attendance center; the physical spaces limitations
related to the classroom learning area; the number of seats or learning
stations available to students; instructional methodology that may dictate
enrollment limitation; the availability of appropriate special education
program; hiring additional staff; purchasing additional equipment, supplies or instructional
materials; specialized equipment or materials; and , the overall cost
effectiveness due to increased enrollment.
Such limitations shall be reduced to written administrative rules and
regulations.
District
policies, rules and regulations for contracting to provide instruction shall
provide for adaptability and administrative discretion for decision making
purposes. The purpose of adaptability
and discretion for decision making purposes shall be to maintain the integrity
of District #1 programs and to not interfere with the quality of education
being provided to resident students.
All
resulting policies, rules, and regulations shall be implemented by the
administrative staff and personnel of the districts as they now exist or as
they may hereinafter be amended.

General.
Except as otherwise provided herein, contract students coming
into
Transportation. The Ashland-Greenwood Public
Schools shall not provide transportation to any contract student, including
handicapped students, electing to attend Ashland-Greenwood Public Schools
unless required by law or an acceptable arrangement is approved by the
Superintendent of Schools, which, except in extremely unusual situations, would
be provided only if the pick-up and drop-off points are on regularly scheduled
bus route of the Ashland-Greenwood Public Schools and there is room on the
bus. Additional pick-up points on
regular routes may be established at a cost of $50 per annum.
Funding.
Payment for contracting students shall be made twice annually at the
beginning of the first semester and at the beginning of the second
semester. Payment plan may be altered
upon the mutual agreement between the contracting party and the district. The charge for contracting shall be set as
per R.R.S. 79-486 utilizing current year charges which shall be determined by
utilizing prior year costs multiplied by 107% for instructional cost
increases. Charges for Special Education
and/or transportation shall be the actual charge for services provided by the
district and shall be in addition to any regular education charges.
The Ashland-Greenwood Schools shall accept all contract students applicants, subject to the
following:
(a) The school district shall not accept
any contract student into any program
class, grade level or school building when acceptance of such student,
(I) would cause overcrowding in that program, class, grade level or school building
as determined by the Superintendent of Schools or his or her designee, or (II)
would significantly increase the operating costs of the school district, such
as by necessitating the hiring of new or additional staff, purchasing
additional equipment, supplies or instructional materials as determined by the
Superintendent or his or her designee.
(b) The school
district shall accept handicapped contract students only to the extent that the
school district’s then current staff, class offerings, programs and facilities
are sufficient to accommodate the needs of such students, (I) without significantly increasing the
operating costs of the school district, such as by requiring the hiring of new
or additional staff, purchasing additional equipment, supplies or instructional
materials as determined by the Superintendent or the Superintendent’s designee,
or (II) without causing overcrowding in
the particular special education program as determined by the Superintendent or
his or her designee. The school district
shall accept handicapped option students only to the extent that the school
district offers classes or programs for such students within the
Ashland-Greenwood Schools and will not accept handicapped contract students who
require services for which the Ashland-Greenwood Schools has no programs on
site within its own school facilities.
(c) Ashland-Greenwood Public Schools
shall not base the decision to accept or
reject a contract student on that student’s previous academic
achievement, athletic or other extra-curricular ability, handicapping
conditions, proficiency in English language.
(d) The school district is determining
whether to accept or reject a contract
student’s request shall consider whether a request to contract has been
filed for appropriate academic reasons and whether there is substantial educational opportunity available to the
contract student in the Ashland-Greenwood Public Schools that is unavailable in
the resident school district.
Appropriate academic reasons for the contract include, but are not
limited to:
(1) Classes are available at
Ashland-Greenwood Public Schools and are not available at one of the schools of
the resident district;
(2) Specialized curriculum available at
Ashland-Greenwood Public Schools and not at the resident district;
(3) Completing high school with classmates
when parents move from Ashland-Greenwood Public Schools.
(4) Family traditions of attending
Ashland-Greenwood Public Schools because of its school philosophy and goals;
(5) Ashland-Greenwood Public Schools
values are consistent with family values.
Reasons considered not appropriate academic reasons include,
but are not limited to the following:
(1) Babysitting availability;
(2) Parent convenience
(3) Athletics as the only reason
(e) In the event that there are more
contract requests and applicants for option enrollment under Board Policy
5111.1 for any program, class, grade level or school building, applicants and
requests for the privilege to contract shall be considered together and shall
be accepted in the following order: Students with brothers or sisters attending
Ashland-Greenwood Public School, either as resident students, contract students
or as option students, shall be granted first priority; thereafter, option
students shall be accepted into such program, class, grade level or school
building in the order in which written applications or written requests for
contracting are received by the school district. If applications for option enrollment and/or
requests for contracting are received at the same time or dates of receipt cannot
be determined, contract students will be accepted on the basis of a random
drawing which may include option students under Board Policy 5111.1.
The School Board or board of Education of Ashland-Greenwood
Public
Schools reserves the right by resolution to declare a
program, class, or school building unavailable to contract students due to lack
of capacity.
The registration procedure for specific classes shall be the
same for a
contract student as for all students at
Ashland-Greenwood Public Schools. Thus,
when a specific class is filled according to the registration procedure, no
more students will be allowed to register for the specific class.
Ashland-Greenwood Public Schools, its officers, agents or
employees,
shall make information about
A contract student shall be subject to all waiting periods
or eligibility
requirements of the Nebraska School Activities
Association.
Ashland-Greenwood Public Schools shall accept credits toward
graduation
that were awarded by another state
accredited or approved school district and shall aware a diploma to a contract
student if the student meets the graduation requirements of Ashland-Greenwood
Public Schools.
The parent or legal guardian of any student or a district
desiring the privilege to contract a student into the Ashland-Greenwood Public
Schools shall file a written request to contract not before September 1 but by
January 1 of the school year preceding the enrollment of the student. The January 1 date may be waived by the
Superintendent or his designee at his or her discretion provided apace as
defined in this policy and under the open enrollment policy 5111.1 is still
available for additional students. The
waiver of application deadlines shall be permitted in instances where a student
changes his or her resident school district after January 1 filing
deadline. Parents/Guardians or districts
contracting at the time of the initial adoption of this policy and regulation
need not file a written request to contract for students already enrolled
in the Ashland-Greenwood schools.
Any written request shall be deemed filed when the request
is actually received and marked or stamped as filed in the office of the
Superintendent of Ashland-Greenwood Public Schools. All requests received by the office of the
Superintendent of the Ashland-Greenwood Public Schools shall be marked or
stamped as being received on the same date at the same time. The request shall be set forth in detail the
substantial educational opportunity available to the student(s) in the
Ashland-Greenwood Schools that is unavailable in the resident school
district. In preparing and filing such
request, the parent or legal guardian should take into consideration the
standards and procedures provided by this policy. The determination of approval or rejection of
requests, limitations, and priorities provided by this policy shall be made by
the Superintendent of the Superintendent’s designee of Ashland-Greenwood Public
Schools.
The Ashland-Greenwood Public Schools’ Superintendent or the
Superintendent’s designee shall notify the parent or legal guardian or school
district of any student who has submitted a request to contract into
Ashland-Greenwood Public Schools, whether the application was accepted or
rejected. If a request is rejected, the
Ashland-Greenwood Public Schools’ Superintendent or the Superintendent’s
designee shall state in the notification the reason for rejection.
No student shall attend Ashland-Greenwood Public Schools as
a contract student with Ashland-Greenwood Public Schools for less than one
school year unless he or she relocates to a different resident district, or
completes requirements for graduation prior to the end of his or her senior
year. Students contracting into
Ashland-Greenwood Public Schools shall be allowed to continue to attend
Ashland-Greenwood Public Schools without refilling of a request to contract
until graduation as long as the contract is kept current and payments are made
within 30 days of being billed for services or as otherwise stipulated within
the contract or this policy.
The Superintendent of Ashland-Greenwood Public Schools is
authorized to implement this regulation.
Any action to be taken herein by the Ashland-Greenwood Public Schools’
Superintendent may also be taken or performed by the Ashland-Greenwood Public
Schools’ Superintendent’s designee. This
